New York Retake Rules & Pass Rates
After a failed knowledge test: how long you wait before a retake, what the retake costs, and the pass rate where the state publishes one.
- Retake wait (days)
-
There is no waiting period. Neither the Vehicle and Traffic Law nor the DMV's licensing regulations impose one on a written test taken in an office, and the DMV publishes none, so an applicant may retest as soon as the office can seat them. What limits the applicant is the fee rather than the calendar: the $10 application fee entitles the holder to take the knowledge test no more than twice, and a third attempt requires a new $10 application fee, which in turn buys two more. There is no cap on how many times a person may apply.
- Retake fee
-
New York charges no per-attempt knowledge-test fee. Vehicle and Traffic Law 503(2)(a) sets a $10 fee to initiate the licensing process, and for a non-commercial license that fee lets the applicant take the knowledge test no more than twice. An applicant who fails both attempts must pay a new $10 application fee to test again. (For CDL applicants the same fee covers only one knowledge test.) The separate $10-per-test road-test fee in VTL 503(2)(b) applies to the road test, not the written test.
- Knowledge-test pass rate (%)
-
70% pass; 2020-2023 pooled; all tests administered (first attempts not separated); knowledge test. The figure comes from a 2024 analysis of test results supplied by 36 state licensing agencies, pooled across 2020 to 2023. It counts every test administered, so retakes are mixed in with first attempts.
