Nevada License Suspension Rules

How this state counts violations toward suspension (points or convictions) and how DUI, reckless driving, and excessive speeding factor in.

DUI treatment under this scheme

DUI convictions are not assigned demerit points. They trigger direct license revocation: at least 185 days for a first offense, one year for a second offense within 7 years, and three years for a third offense within 7 years or for a DUI causing death or substantial bodily harm. Administrative and criminal revocations may be served concurrently at the judge's discretion.

Reckless treatment under this scheme

Reckless driving carries 8 demerit points. Combined with other infractions (careless driving at 6 points, failure to render aid at 6, failure to yield or disobeying a signal at 4), a reckless conviction alone gets a driver most of the way to the 12-point suspension threshold within a 12-month window. Reckless driving that causes substantial bodily harm is treated as a major offense and triggers direct revocation rather than points.

Excessive speeding treatment under this scheme

Speeding is pointed by how far over the posted limit you were caught: 1 point for 1 to 10 mph over, 2 points for 11 to 20 mph over, 3 points for 21 to 30 mph over, 4 points for 31 to 40 mph over, and 5 points for 41 mph or more over the posted speed limit. A prima facie speed violation or driving too fast for conditions adds 2 points. Speeding fines double in work zones.
