- Implied consent / refusal consequences

Under Nevada's Implied Consent Law (NRS 484C.220), if an officer suspects you are driving under the influence you must submit to a blood, breath, or urine test. Refusing the test revokes your driving privilege for one year on a first refusal, or three years if your driving privilege has been revoked in the prior seven years for failure to submit. An officer may also direct that blood samples be drawn, even on a first offense.

- DUI first-offense consequences

Administrative: license revoked for 185 days when chemical tests show 0.08 percent BAC or any detectable amount of a controlled substance (drivers under 21 face the same 185-day revocation at 0.02 percent). You may be required to file an SR-22 Proof of Financial Responsibility. Criminal: license revoked for at least 185 days (the judge may credit time served in the administrative revocation), jail of 2 days to 6 months or 48 to 96 hours of community service, $400 to $1,000 fine, mandatory DUI school tuition (averaging $150), and possible court-ordered treatment when BAC is 0.08 percent or higher. Driving privileges may be reinstated early during the revocation period if you obtain an ignition interlock restriction and install the device at your own expense in any vehicle you operate.
